REGULAR COUNCIL MEETING

January 11, 2010

 

The Mechanicsville City Council met in regular session on Monday, January 11, 2010 at the Memorial Building.  Mayor Boyd A. Stine called the meeting to order at 7:00 p.m.  Council members present for roll call were Larry Beck, Carla Barnhart, Gene Brown, Calvin Paup, and Deanna Cook.  Others present included Jim Barber, Alan Zerbe, Lonni Koch, Kerri Poduska, Rob Davis, Doyle Pickering, Kris Davies, Linda Beck, and Stephanie Kamberling. 

 

Receive visitors/public comment:  Kris Davies addressed the council on the necessity of enforcing the no parking between from 3 am to 7 am November 15 to April 15.  At the present time that is how the ordinance reads and the parking tickets will stand, going forward the council will review the signage, the language of not only the no parking ordinance on First Street between Cherry and Jackson, but also the use of the snow emergency and limiting the parking elsewhere within the city during the snow season.  Zerbe, Barber, Barnhart and Brown will review.

 

CONSENT AGENDA: Larry Beck motioned, Carla Barnhart seconded to approve all items under the consent agenda including the agenda, finance reports, claims, and minutes from 12/14/09. Roll call vote: Ayes:  Beck, Brown, Barnhart, Cook and Paup. Nays: None. Motion carried.

REPORTS:

 

Ambulance Report: Kerri Poduska presented the ambulance report which included 18 medical calls and 1 trauma, 1 tier with A-5, 3 calls to Stanwood, one standby for house fire; and 1 cancelled en-route for a total of 20 calls.  Larry Beck motioned, Gene Brown seconded to approve the request for 2 to attend the EMS Leadership Conference at a cost of $197.43 on January 28.  Ayes all.  Motion carried. 

 

Fire Department Report: Lonni Koch reported a basement fire, assist Adam 3 on an ambulance call, a garage fire, and a mutual aid to Lisbon which was cancelled en-route.  John Bemer resigned as 3rd assistant and Bob Moravek was elected to fill that position.  The second annual Daffy Derby will be 10am-4 p.m. at the sale barn on Sat. January 16.

 

Police Report:  Police Chief Jim Barber reported on the activity for 2009 including 9 accidents; 69 agency assists, 38 animal cases, 10 arrests, 7 assist motorist, 2 assaults, 10 burglary, 137 citizen assist, 7 criminal mischief, 5 domestic assaults, 21 harassment, 83 -911, 12 thefts, 68 traffic stops with 12 citations and 56 warnings, 1 welfare check, 6 abatements filed, 5 bad check notices served; 120 warnings for code violations, and 78 non traffic citations issued.

 

Public Works Report: Alan Zerbe reported that the batteries have been replaced in the emergency lighting at city hall, fire station, medical center, and memorial building, roof on library has a leak which appears may be due to a lack of ventilation between the ceiling and the roof, not able to repair until this summer; sand and salt was delivered and requested that the city consider building a salt shed during the next budget along with the repairs to the library; cable on plow broke and was repaired, moving snow; lift station alarm went off on Sunday and was put into backup mode over night, reset Monday.  A proposal for repairing/replacing the door opener from Barron Equipment was approved with a motion by Gene Brown, seconded by Calving Paup at a cost of $785 for materials, freight and installation and if scissors lift is needed an additional cost of $125.  Ayes all.  Motion carried.

 

Administration Report:  Coppess reported that the library assistant position was posted, applicants interviewed, and an offer has been made at $10.85/hour.  A request for vacation was approved with a motion by Larry Beck, seconded by Carla Barnhart.  Ayes all.  Motion carried.

 

Old Business:

Follow up on ball field proposal: Council was provided with the written document summarizing the discussions that had taken place previously with the school and school officials and included that the school will not be providing any funds for the project, the school is concerned about the cost of the facility upkeep, concern that the plans may put the complex too close to the school, some interest in a smaller school play area, concern that the location may be difficult to monitor and might interfere with the geo-thermal heat source, binding financial commitments must be in place before decisions are made, detailed drawings must be approved before decisions are made, and the district has prescribed legal steps to follow when utilizing district property or funds. 

 

Proposals for replacement of doors at Memorial Building:  Two proposals were received for the labor only to replace the doors at the memorial building with the entrance doors being $4,623 and the back doors being $1,690, council requested that the cost of the doors be determined so that a total cost could be determined before making a decision.

 

Second reading of ordinance amending provisions pertaining to council compensation:  Larry Beck motioned, Carla Barnhart seconded to approved the second reading of the ordinance that would allow a council person to not receive said compensation by submitting a written statement to the City Clerk stating the desire not to be compensated.  Ayes all.  Motion carried.

 

A motion was made by Larry Beck, seconded by Deanna Cook to waive the third reading of the ordinance.  Ayes all.  Motion carried.

 

A motion was made by Larry Beck, seconded by Deanna Cook to adopt the ordinance.  Roll call vote: Ayes:  Beck, Brown, Barnhart, Cook and Paup. Nays: None. Ordinance adopted.

 

Appointment of City Attorney:  Calvin Paup motioned, Gene Brown seconded to appoint Douglas Simkin as the city attorney.  Ayes all.  Motion carried.

 

New Business:

DISCUSSION AND POSSIBLE ACTION ON:

 

Resolution 2010-1 to authorize a demolished building burn:  Carla Barnhart motioned, Larry Beck seconded to adopt the resolution authorizing Luke Oberbreckling to conduct a demolished building burn whereas the old school building will be demolished, hauled to his property in Jones County, and burned between the hours of 6am and 6 pm. Roll call:  Ayes:  Beck, Brown, Barnhart, Paup, and Cook.  Nays:  None.  Resolution adopted.

 

Snow chasers snowmobile club request written permission to travel through town:  Calvin Paup motioned, Deanna Cook seconded, to send a copy of the ordinance and the approved snowmobile route to the group and it will be up to them to know what the approved route of travel is.  Ayes all.  Motion carried.

 

Name official newspaper:  Larry Beck motioned, Gene Brown seconded to name the Tipton Conservative as the official newspaper.  Ayes all.  Motion carried.

 

Appoint mayor pro-tem: Mayor Boyd Stine appointed Gene Brown as Mayor Pro-tem.

 

Mayor appoint committees:  The Mayor Stine appointed the committees for 2010 to be as follows:  Public Safety Calvin Paup and Gene Brown; Public Works Larry Beck and Gene Brown; Culture and Recreation Carla Barnhart and Deanna Cook; Health & Social Services Deanna Cook and Gene Brown; Community & Economic Development Carla Barnhart and Calvin Paup; General Government Larry Beck and Calvin Paup; Debt Service Carla Barnhart and Deanna Cook; Capital Project Larry Beck and Calvin Paup; Business Enterprises Gene Brown and Carla Barnhart.

 

Budget items:

Township agreements for fire protection- Council reviewed the proposed changes to the township agreement to incorporate a fee schedule in addition to the taxation that is received from the townships.  Calvin Paup motioned, Larry Beck seconded to approve the agreement as presented subject to review by the city attorney, before approving the resolution adopting the fees and establishing the ordinance to set the fees.  The questions regarding how to handle those that will not pay or can not pay as well as if some townships agree to the fee schedule and others do not.  Ayes all.  Motion carried.

 

Ordinance establishing charge for service- & Resolution adopting fee schedule for fire service will be tabled until response is received from city attorney.

 

Renewal of Aramark Uniform Services Contract: Gene Brown motioned, Deanna Cook seconded to discontinue the Aramark Uniform Services Contract and convert to an annual uniform allowance that would purchase the shirts and employees would self-launder.  Ayes all.  Motion carried.  Alternative options for shop rags are also available.

 

Other items to include for consideration for the 2011 budget: Items identified to get pricing for in order to try to include in the 2011 Budget included a salt shed, shingles for the roof at the park pavilion and the treatment plant, squad car, doors at the Memorial Building, hard surfacing 125th Street, replacing the smaller mower, and park improvements.

 

Policy Statement Resolution 96-2- Barnhart requested that Resolution 96-2 be reviewed every year in January and identify items that were obsolete.

 

Committee Reports:  None

 

Correspondence was received from USDA Rural Development, Emergency Management 1/14/10 planning meeting, ECIA Employment Handbook,

IAMU Safety Group insurance seminar and thank you’s from the Kelly Eby family.

 

Mayor’s Comments: Mayor Stine stated that he was enjoying the learning process.
